WaterMarks and CopyRights

December 22, 2012  •  Leave a Comment

I am just like you all... ... ... i really and seriously hate watermarks and (copyrights also).

However in this current era of using the internet for business they are very much needed,

to protect the artist from having their work lifted and used with out their express written

permission.  In the past I have run several tracking software's and found hundreds of

people posting my images on their sites...some left my water mark on the images and others

tried hard to remove it... my watermark is a colorful rendition of my web address...those I will

mostly leave alone as it brings others to my site to view and hopefully buy some of my art

prints or want to hire me for commission work, portraits, headshots, weddings and so forth.

Unfortunately they are a necessary eveil in this world and economy today.

But do remember that if you lift any item from a website, whether or not it is watermarked,

it is still protected by copyright laws of the country of origin.  For example my work is all

covered by US Copyright Law, even though it is not written directly on the image as a watermark.

An artists' work is copyright protected the instant it is created, in my case in the camera.  Of course

I have gone a little farther and embedded a copyright statement into the original raw file and it stays

attached even to when converted to a jpg or tiff for printing.  Also I never delete or destroy any of my

original files just in case I have to take someone  to court.  I will first of all try to enlighten an infringer

on copyright ownership and also send an invoice for the infringement.  If the infringer does not comply

then I have the option to bring charges.  I currently reside in Wichita Kansas and the United States

District Court is less than 4 miles from my house, so it is not an imposition for me to go tere to file a

criminal case with them.  As Copyright infringement is a FEDERAL LAW not a city or county or state law,

it is a Federal Law.  So rather than make a person come here, spend weeks on end fighting a case they

will lose I prefer to just deal with it without the court system... ... ... unless I simply have to take that route.

I am sorry for the long tirade but I just wanted to clarify the fact that I really do not like using watermarks

and why it is so necessary.

have a wonderful Yule / Christmas, and a very prosperious New Year... ... ... 2013 is going to be great.
